Overburdened Hamburg Courts Imperil Housing Market
Problem Summary
The Association of North German Housing Companies (VNW) has denounced the severe strain on Hamburg’s district courts, resulting in a backlog of housing-related legal cases. Consequently, numerous evictions and inheritance matters remain unresolved, leaving much-needed apartments unoccupied and inaccessible.
As of August 31, 2024, the eight district courts in Hamburg had 1,540 pending inheritance cases, according to the Senate. The association highlights that this issue has persisted for years.
Impact on Housing Market
Andreas Breitner, VNW director, emphasizes the dire consequences for the housing market: "The staffing crisis at Hamburg’s district courts has detrimental effects on the housing market. Urgently needed housing units cannot be rented out due to the lack of court decisions."
This situation exacerbates the already tight housing market, withholding vital accommodations and creating unnecessary vacancies. "This is a slap in the face of those who spend months searching for suitable housing," declares Breitner.
Moreover, landlords face mounting debts without a realistic prospect of collecting outstanding payments. "This can be financially devastating for some landlords," warns the VNW director.
Political Response
The Christian Democratic Union (CDU) in Hamburg’s parliament has echoed the criticism of the overburdened courts. "It is particularly disturbing that this problem has been known for years, yet the SPD and Greens have failed to take adequate measures to resolve it," states Richard Seelmaecker, CDU politician.
He accuses Justice Senator Anna Gallina (Greens) of neglecting her responsibility to address the staffing shortages in the judiciary.
Long-Standing Issue
The VNW contends that the staffing issues in Hamburg’s courts have been widely known for several years. Despite repeated calls for action, the authorities have not taken sufficient steps to alleviate the problem.
The association argues that the government’s inaction has hindered the efficient administration of justice, leaving tenants, landlords, and the housing market as a whole in a precarious situation.

The VNW urges the authorities to take immediate and decisive measures to address the staffing crisis in Hamburg’s courts. This includes:
