WhatsApp Surpasses EU Threshold, Obligated to Enhance Content Moderation Measures
WhatsApp, the Meta-owned messaging platform, has surpassed a pivotal user threshold stipulated by the European Union’s landmark Digital Services Act (DSA). This milestone triggers heightened responsibilities for WhatsApp in combating online illegal and harmful content.
DSA User Threshold
The DSA, a comprehensive regulatory framework, defines "very large online platforms" as those with a monthly active user base exceeding 45 million within the EU. These platforms are subject to stricter obligations to ensure the safety and integrity of their services.
WhatsApp’s User Count
As per its February 14 filing, WhatsApp reported an average of 46.8 million active users in the EU during the six-month period ending in December 2024. Consequently, it falls within the "very large platform" designation under the DSA.
EU Confirmation
The European Commission’s spokesperson, Thomas Regnier, confirmed WhatsApp’s compliance with the user threshold. This designation places WhatsApp under the obligation to take comprehensive measures in accordance with DSA requirements.
DSA Compliance Obligations
Within four months of being designated as a "very large platform," WhatsApp must undertake the following actions:
- Risk Assessment: Identify and assess risks to illegal content, fundamental rights, public security, and child protection on its platform.
- Risk Mitigation: Implement appropriate measures to mitigate the identified risks, including collaboration with law enforcement, user education, and content filtering.
- Transparency: Publish regular reports on the measures taken to address illegal and harmful content.
Consequences of Non-Compliance
Violations of DSA obligations can result in significant penalties, including fines of up to 6% of a company’s global annual revenue. Meta’s other platforms, Instagram and Facebook, are already classified as large online platforms under the DSA.
Criticism of EU Tech Rules
Meta’s CEO, Mark Zuckerberg, and its chief lobbyist, Joel Kaplan, have expressed opposition to EU tech regulations. They have also sought support from U.S. President Donald Trump.
