United Airlines Faces Lawsuit Alleging Antisemitic Incident and Unjustified Detention

A federal lawsuit filed in New York on Wednesday accuses United Airlines, along with several government agencies, of subjecting two passengers to discriminatory treatment, physical and emotional distress, and unlawful detention during a flight from Tulum, Mexico, to Houston, Texas, in January. The plaintiffs, Yisroel Liebb and Jacob Sebbag, allege that a United Airlines pilot forcibly removed Liebb from a lavatory, made antisemitic remarks, and instigated their subsequent detention by Customs and Border Protection (CBP) officials. The lawsuit names United Airlines, the Department of Homeland Security, CBP, and the Transportation Security Administration (TSA) as defendants.

According to the complaint, the incident unfolded on January 28 when Liebb experienced constipation shortly after the flight’s departure. After approximately 20 minutes, a flight attendant, concerned about the prolonged bathroom visit, requested that Sebbag check on his traveling companion. Sebbag relayed the situation to the flight attendant, informing them of Liebb’s condition.

The lawsuit details that, ten minutes later, a pilot aggressively confronted Liebb while he was still inside the lavatory, demanding his immediate exit. The complaint further alleges that the pilot instructed Sebbag to forcibly remove Liebb from the bathroom. When Liebb failed to comply quickly enough, the pilot allegedly broke the lock on the lavatory door and forcibly pulled Liebb out, with his pants reportedly around his ankles, exposing him to the other passengers.

The plaintiffs allege that, as they were escorted back to their seats, the pilot made threats of getting them arrested and directed disparaging remarks toward them regarding their Jewish faith and behavior. The lawsuit emphasizes that both men were visibly wearing traditional Jewish attire.

Upon the flight’s arrival in Houston, Liebb and Sebbag were met by CBP officers, handcuffed, and taken into custody. According to the lawsuit, when Liebb questioned the justification for their detention, one of the CBP officers responded with the dismissive statement, "This isn’t county or state, we are homeland, you have no rights here." The lawsuit underscores that both men are American citizens.

The legal action asserts that the plaintiffs experienced significant unwarranted delays in their travel plans as a direct result of the incident. They also claim to have suffered physical injuries, extreme discomfort, profound emotional distress, and public embarrassment. Liebb, in particular, claims to have experienced sexual violation and deep embarrassment due to being publicly exposed in a state of undress.

The lawsuit details the tangible consequences of the detention, highlighting that Liebb and Sebbag missed their connecting flight to New York. While United Airlines provided them with a flight the following day, the lawsuit argues that the expenses incurred for food and lodging in Houston effectively negated the value of the complimentary flight.

The claim that a pilot forcibly removed a passenger from a lavatory, while already a cause for concern, is compounded by the allegation of antisemitic remarks.
