Department of Education Launches Title IX Investigations into Athletic Associations Defying Trump’s Transgender Athlete Order

The United States Department of Education has initiated Title IX investigations into athletic associations in California and Minnesota following their announcements that they would disregard President Trump’s executive order barring transgender athletes from competing in girls’ and women’s sports.

California Interscholastic Federation and Minnesota State High School League Defy Executive Order

The California Interscholastic Federation (CIF) and the Minnesota State High School League (MSHSL) both declared their intent to continue allowing transgender athletes to participate in accordance with state laws permitting athletes to identify their gender for competitive purposes.

Department of Education’s Response

Craig Trainor, acting assistant secretary for civil rights, responded by asserting that the organizations were obligated to comply with federal law, which would be enforced through directed investigations by the Department of Education’s Chicago and San Francisco regional offices.

Trainor emphasized the need to ensure dignity, respect, and equality for female athletes by adhering to federal anti-discrimination laws, which supersede state laws in this matter. He warned that entities opposing such laws risked historical condemnation.

Trump’s Executive Order

President Trump signed the executive order on National Girls and Women in Sports Day, emphasizing the administration’s policy to protect equal athletic opportunities for all females. The order threatened to withhold funding from educational programs that deny fair opportunities to women and girls in sports.

NCAA and International Olympic Committee

Prior to the executive order, White House press secretary Karoline Leavitt indicated that part of its purpose was to pressure the International Olympic Committee (IOC) and the NCAA to adopt similar policies. The NCAA subsequently revised its policy, which had previously allowed transgender athletes to compete based on their gender identity.

Homeland Security Ban on Transgender Athletes

During the executive order signing ceremony, Trump announced that Homeland Security Secretary Kristi Noem would prohibit transgender athletes identified as male at birth from entering the United States for the 2028 Olympics.

United Nations Study

The Department of Education cited a United Nations study claiming that nearly 900 biological females had been denied medals due to competition against transgender athletes.

Supreme Court Case

Minnesota, led by Governor Tim Walz, has been at the center of a Supreme Court case involving a transgender powerlifter seeking to compete against biological women.
