Deerfield School District Faces Federal Investigation Over Transgender Locker Room Policy

Deerfield Public Schools District 109 is under federal investigation following allegations that its policy regarding transgender students’ access to locker rooms violates Title IX. The investigation was launched after a parent, Nicole Georgas, filed a civil rights complaint alleging that school administrators pressured her daughter to change in the same locker room as a transgender student.

The district stated that it is "sensitive to the privacy needs of all of our middle school students and ensure that no student is required to change into a gym uniform for physical education class in front of others."

To further address privacy concerns, the district noted that when both middle schools were renovated in 2017, five private changing stations were added to each locker room, available for use by any student. Additionally, students have the option to change in a private location separate from the locker room if they prefer.

The controversy began when Georgas’s 13-year-old daughter refused to change into her physical education uniform because a transgender student was present in the girls’ locker room. Georgas subsequently raised the issue with school administration, arguing that the policy violated former President Donald Trump’s executive order concerning men in women’s sports. According to Georgas, the school administration informed her that their legal counsel advised that the transgender student was permitted to use both the girls’ bathroom and locker room.

During a recent Board of Education meeting, Georgas expressed her concerns, stating, "The girls want their locker rooms and bathrooms back. They want their privacy back. This is why I’m here tonight. My 13-year-old daughter’s well-being, mental health and privacy are at stake."

The U.S. Department of Education’s Office of Civil Rights has initiated investigations into the Illinois Department of Education, Chicago Public School District 299, and Deerfield Public Schools District 109. These investigations will examine whether the districts’ policies and practices comply with Title IX, a federal law that prohibits sex-based discrimination in any education program or activity receiving federal financial assistance.
