Microsoft is doubling down on its commitment to AI safety by publicly identifying individuals allegedly responsible for bypassing safeguards on its generative AI tools to create realistic deepfake images, including those of celebrities. This move comes as an amendment to a lawsuit filed last year, demonstrating a proactive stance against the misuse of AI technology and its potential for harm.

The lawsuit, initiated in December, gained significant traction when a court order allowed Microsoft to seize a website connected to the operation. This action proved instrumental in uncovering the identities of the individuals involved. According to Microsoft, these developers are part of a global cybercrime network known as Storm-2139. The identified individuals include: Arian Yadegarnia, also known as “Fiz,” from Iran; Alan Krysiak, known as “Drago,” from the United Kingdom; Ricky Yuen, known as “cg-dot,” from Hong Kong; and Phát Phùng Tấn, known as “Asakuri,” from Vietnam.

Microsoft has indicated that it has identified other individuals involved in the scheme but is withholding their names to avoid interfering with an ongoing investigation. The company alleges that the group gained unauthorized access to its generative AI tools and successfully bypassed the built-in safety measures, effectively "jailbreaking" the systems. This allowed them to generate images of any kind, unrestricted by ethical or legal considerations.

The primary motivation behind this activity appears to have been financial gain. The group allegedly sold access to their “jailbroken” AI tools to others, who then exploited the technology to create deepfake nudes of celebrities and engage in other forms of abuse. The incident underscores the potential for malicious actors to exploit generative AI for harmful purposes.

The seizure of the group’s website and the unsealing of legal documents in January reportedly triggered a panic among the defendants. Microsoft reported that the action caused internal strife within the group, with members turning on each other and attempting to deflect blame. This indicates that the legal pressure is having a tangible impact on the perpetrators.

The issue of deepfake pornography has gained widespread attention, particularly due to its targeting of high-profile figures like Taylor Swift. Celebrities have become frequent targets of this type of abuse, where their faces are convincingly superimposed onto nude bodies. This has prompted Microsoft and other tech companies to enhance their AI safety measures. In January 2024, Microsoft was forced to update its text-to-image models after fake images of Swift surfaced online.

The ease with which generative AI can create realistic images, even with limited technical skills, has contributed to a surge in deepfake scandals. Recent stories from individuals targeted by deepfakes highlight the emotional distress, anxiety, fear, and sense of violation that these images can inflict.

One side advocates for keeping AI models closed-source, arguing that this approach can help prevent misuse by limiting users’ ability to bypass safety controls. The other side champions the open-source model, arguing that making AI models freely available for modification and improvement is essential for accelerating innovation. The NO FAKES Act, introduced in Congress last year, would make it a federal crime to generate images based on someone’s likeness without their consent. The United Kingdom already penalizes the distribution of deepfake porn, and soon, the production of such content will also be a crime. Australia has recently criminalized both the creation and sharing of non-consensual deepfakes.

Microsoft’s actions underscore the urgency of addressing AI safety concerns and the importance of holding accountable those who misuse the technology for malicious purposes.
