DOJ Investigates NY AG Letitia James Amidst Allegations of Loan Misrepresentation

The Department of Justice (DOJ) has initiated a criminal investigation into New York Attorney General Letitia James, a development confirmed by Fox News. A grand jury in the Eastern District of Virginia has reportedly issued subpoenas related to accusations that James misrepresented the status of a single-family home in Virginia to secure more favorable loan terms.

The investigation follows a criminal referral submitted by William Pulte, the former Director of the Federal Housing Finance Agency under the Trump administration. Pulte requested the DOJ to investigate James concerning the Virginia property and a separate incident involving a multifamily property in Brooklyn. In the Brooklyn case, James is alleged to have misrepresented the number of livable units in order to obtain more advantageous loan terms.

Abbe Lowell, James’ attorney, has vehemently dismissed these allegations, characterizing them as "baseless and long-discredited." Lowell asserted that the accusations were thoroughly addressed in a letter sent to the Department of Justice on April 24th. He further suggested that the resurfacing of these allegations is politically motivated, occurring shortly after former President Trump publicly criticized Attorney General James.

Lowell raised concerns that the investigation may be a form of political retribution threatened by Trump, a scenario that former Florida Attorney General Pam Bondi had assured the Senate would not occur under her watch. Lowell emphasized his willingness to cooperate with prosecutors if they are genuinely interested in the truth and prepared to counter false claims with factual evidence.

Following Pulte’s criminal referral, Lowell sent his own letter to Bondi and the Justice Department, accusing Trump of seeking political retribution against James. Lowell’s letter directly addressed the "stunning hypocrisy" of Trump’s past complaints about the politicization and weaponization of the Justice Department, contrasting them with his current administration’s request to undertake the same practices against James.

He specifically cited instances where Trump called for revenge and personally attacked James, suggesting a clear pattern of animosity that casts doubt on the impartiality of the investigation.

In response to the specific allegations, Lowell addressed the claim that James listed the Virginia property as her primary residence while serving as a state official in New York. He argued that James had no intention of using the property as a primary residence and that the indication in a power-of-attorney letter was a mistake. Lowell emphasized the existence of other documents where James explicitly informed her lender that the Virginia home would not be her primary residence.

Regarding the Brooklyn property, Lowell refuted the claim that James inflated the number of livable units to receive better interest rates. He accused Pulte of disregarding updated documentation listing the residence as a four-unit multifamily building and instead relying on a certificate of occupancy from 2001.

The investigation comes at a politically charged time, given James’ prominent role in legal challenges against Trump and his organization. Accusations of political motivation surrounding the investigation are likely to intensify the scrutiny surrounding the DOJ’s actions.
