Germany Enacts Landmark Law for Domestic Violence Victims

Germany has taken a historic step towards protecting women and children affected by domestic violence by passing the Gewalthilfegesetz (Violence Assistance Act). This comprehensive legislation establishes a legal entitlement to counseling and protection for victims, a significant milestone in the fight against gender-based violence.

The law, which will come into effect on January 1, 2032, guarantees affected individuals access to free protection and counseling services. To ensure adequate support, the government will invest 2.6 billion euros between 2027 and 2036 to expand the existing infrastructure of women’s shelters, safehouses, and counseling centers.

Under the new law, states will be legally obligated to provide sufficient services, ensuring victims have reliable access to support. This marks a significant departure from the previous system, where funding was voluntary and dependent on local budgets, often resulting in financial obstacles for victims seeking assistance.

The law not only establishes an entitlement to assistance but also makes it legally enforceable. Victims will have the right to take their cases to administrative courts if their access to support is denied. However, it’s important to note that the entitlement does not guarantee a place in a women’s shelter, as individual institutions retain the discretion to decline admission.

Addressing Historic Funding Gap

Historically, women’s shelters have relied on voluntary funding from states and municipalities, often leaving victims facing financial barriers to accessing these vital services. The Gewalthilfegesetz addresses this issue by making the federal government a financial partner in supporting women’s shelters.

Scope of Protection

The initial draft of the legislation proposed extending protection to all individuals facing violence based on their gender or gender identity, including women, men, intersex, transgender, and non-binary people. However, the conservative Christian Democratic Union (CDU) objected, leading to a revision of the text to focus primarily on victims of domestic violence.

Strengthening Protections in a Climate of Violence

The Gewalthilfegesetz responds to the alarming increase in violence against women and within domestic settings. Statistics reveal that almost every day, a woman or girl in Germany dies as a result of gender-based violence, and every other day, the perpetrator is an intimate partner or ex-partner. The German Women’s Council estimates that there is a shortfall of approximately 14,000 places in women’s shelters, underscoring the urgent need for enhanced support services.

The Bundesrat’s approval of the Gewalthilfegesetz is a testament to the government’s commitment to addressing the scourge of domestic violence. As the law enters into force, the focus will shift to its implementation, ensuring that the resources and infrastructure are in place to provide victims with the protection and support they deserve.
