Surrogate Mother Sues Fertility Clinic after Implantation of Mismatched Embryo
A Georgia woman is suing a fertility clinic after she unknowingly carried a child that was not genetically related to her. The lawsuit, filed Tuesday in a Savannah court, alleges that the woman was "unwittingly and unwillingly implanted with an embryo that was not biologically hers."
The woman, who wishes to remain anonymous, decided to undergo in vitro fertilization (IVF) using a sperm donor and her own egg. She chose a sperm donor with blonde hair and blue eyes, similar to her own physical characteristics. However, in December 2023, she gave birth to a "dark-skinned, African American" child. It was "apparent" that the child was not genetically related to her, and a subsequent DNA test confirmed this.

When the fertility clinic notified the biological parents of the child, they filed for custody. At five months old, the child was removed from the woman’s care and handed over to his biological parents.
"I left that building with an empty car seat, and they walked out with my son," the 38-year-old mother told NBC News.
The ordeal has left an emotional scar on the woman, who thinks about the child constantly, according to ABC News. "I raised him for five months, but I didn’t get to see him take his first steps. I don’t know what his first words are," she said. She is unlikely to ever see the child again, as stated in the lawsuit.
