Frankfurt Knife Attack: Moldovan Man Sentenced for Manslaughter

Around ten months after a knife attack in Frankfurt, the perpetrator has been sentenced to three years in prison for aggravated assault. The presiding judge of the jury chamber at the Frankfurt Regional Court justified the ruling by stating that there was no intent to kill. The man was significantly impaired by alcohol at the time of the incident, and the case was considered a lesser offense.

The 41-year-old from Moldova was initially charged with attempted perfidious murder, but the prosecution withdrew this accusation during their plea.

In early 2024, the man had come to Frankfurt to work on a construction site. He resided in a single-family home where sleeping quarters in dormitory rooms were rented for ten euros per night.

On April 13, he heavily consumed beer and vodka, resulting in a blood alcohol content of nearly three per mille in the evening. Along with other residents, he stood in front of the house, boasting loudly about a previous prison sentence for stabbing someone to death in Russia, according to the court’s findings. The other residents felt harassed and ordered him to either return to his room or move out.

Following a brief struggle, he entered the house and retrieved a knife with a 15-centimeter-long, rusted blade from the kitchen. He then returned to the front door and stabbed one of the men from behind in the back, just below the shoulder blade. "You wanted revenge, but not his death," the judge stated. Otherwise, he would have chosen a more dangerous area of the body, such as the neck, for the stab.

The blade broke off, and later in the hospital, the wound did not even require stitches. According to the judge, the man was "brutally beaten up" by the friends of the victim after the attack, resulting in injuries significantly more severe than his victim’s. He fled bleeding to a neighbor, who alerted the police.

Prosecutor’s Assessment

Initially, the prosecution had accused the man of attempted perfidious murder, a more serious offense that carries a longer prison sentence. However, during their plea, they downgraded the charge to aggravated assault. The prosecutor argued that due to the man’s diminished responsibility caused by alcohol consumption, there was no clear intent to kill.

Defense Attorney’s Argumentation

The defense attorney highlighted the man’s lack of premeditation and the relatively minor nature of the victim’s injuries. They argued that their client’s actions were primarily driven by provocation and intoxication, rather than malicious intent.

Court’s Decision

After considering the arguments presented by both sides, the court concluded that the accused was guilty of aggravated assault. The presiding judge emphasized the man’s reduced culpability due to intoxication and the absence of a clear intent to kill. The court also took into account the victim’s relatively mild injuries and the mitigating circumstance of the provocation he had experienced.

The court ultimately sentenced the man to three years in prison for aggravated assault. The verdict falls short of the maximum sentence for this offense, which can range up to ten years.

The court’s decision reflects the nuanced nature of criminal liability in cases involving diminished responsibility due to intoxication. While the accused’s actions were clearly unlawful and harmful, the court recognized that his impairment significantly reduced his culpability.
