Fox News legal analyst Gregg Jarrett expressed confidence that the Supreme Court will rule in favor of President Donald Trump and billionaire Elon Musk in the lawsuits filed by 14 Democratic states seeking to block DOGE’s efforts to access federal data and curb government spending.
Jarrett’s Commentary on Fox & Friends
Appearing on Fox & Friends on Monday, Jarrett stated that "presidents have broad authority under Article II of the Constitution to govern and control agencies in departments in the executive branch." He emphasized that Trump is exercising his "core responsibility" to serve the public interest by combating waste and fraud in government spending.
Jarrett dismissed the argument that Trump cannot delegate his authority to Musk and DOGE without Senate confirmation, citing a "large body of law" that grants the president the power to confer administrative powers to others. He believes that the setbacks in lower courts were anticipated and that the Supreme Court will ultimately prevail in favor of Trump.
Public Support and Supreme Court Sentiment
Jarrett pointed to a CBS poll indicating that 70% of Americans agree with Trump’s actions, suggesting that public sentiment is on his side. He also argued that the Supreme Court is not oblivious to the public’s disapproval of government waste and fraud.
Skepticism from Federal Judge
However, a federal judge overseeing one of the lawsuits expressed skepticism towards the efforts to bar DOGE’s access to federal data and firing of federal workers. Judge Tanya Chutkan has yet to issue a ruling but indicated that she will do so within 24 hours.
DOGE’s Actions and Alleged Revelations
The lawsuits challenge DOGEs actions within seven federal agencies, including the Office of Personnel Management, Department of Education, Department of Labor, Department of Health and Human Services, Department of Energy, Department of Transportation, and Department of Commerce.
DOGE and Musk allegedly uncovered shocking revelations, including the estimate that 20% of government spending is wasted, amounting to billions in misplaced funds. Jarrett believes that Americans are fed up with this waste and that Trump is responding to their concerns.
Arguments from Democratic State Attorneys General
Attorneys general from 14 Democratic states argue that Musk and Trump’s administration have engaged in illegal executive overreach. They contend that DOGE’s actions exceed the president’s authority and violate the Appointments Clause of the Constitution.
Ruling on Payment System Access
In a separate case, a federal judge extended a temporary order blocking DOGE from accessing payment systems within the Treasury Department. This decision was made in response to a lawsuit by 19 state attorneys general alleging that DOGE illegally accessed the payment system at the Trump administration’s behest.
