A subsequent indictment added two more counts: one of sex trafficking and one of transportation to engage in prostitution, specifically related to an alleged victim identified as "Victim-2".
In total, Combs is charged with two counts of sex trafficking, two counts of transportation to engage in prostitution, and one count of racketeering. The racketeering charge, brought under the Racketeer Influenced and Corrupt Organizations (RICO) Statute, is particularly significant. RICO is typically used to target multi-person criminal organizations, allowing the government to prosecute individuals for participating in an illegal scheme, even if they didn’t directly commit every act.
Prosecutors are leveraging RICO law to argue that Combs orchestrated a criminal enterprise, coercing victims through intimidation and the use of narcotics to participate in what they describe as "freak offs," sometimes days-long sex performances that they claim to have video evidence of. The implication is that Combs used his wealth and influence to create a system of abuse, where victims were exploited and controlled for his personal gratification.
While the federal criminal trial focuses on these specific charges, it’s important to note that it doesn’t encompass the dozens of civil lawsuits filed against Combs over the past year. These civil suits, separate from the criminal case, allege a wide range of abuses, including sexual assault, rape, and physical violence, with some claims involving minors. During a court hearing in late April, they argued that Combs is not guilty of federal sex crimes because, in his view, he was simply engaging in sexual "swinging." Swinging, a consensual but non-monogamous sexual behavior, involves singles or partners in committed relationships engaging in intimate acts with others.
Combs’ attorney, Marc Agnifilo, acknowledged that they shouldn’t argue Combs is being selectively targeted for prosecution. He stressed the need to be able to present evidence of a specific "lifestyle" Combs lived, suggesting that it was a "swingers" lifestyle. The strategy seems to be to portray Combs’ sexual behavior as consensual and within the bounds of a specific subculture, rather than the exploitative and coercive acts alleged by the prosecution.
Despite repeated attempts to secure bail, Combs has been ordered to remain in custody at the Metropolitan Detention Center in Brooklyn, a facility that also houses other high-profile inmates. His legal team has challenged this ruling, but so far, the court has denied his release.
Ironically, one of Combs’ fellow inmates, disgraced FTX founder Sam Bankman-Fried, offered a surprising perspective on the media mogul’s behavior within the prison walls. In an interview, Bankman-Fried described Combs as "kind" to people in the unit and to him personally.
