Trump’s Unconstitutional Actions and the Impending Constitutional Crisis

In the first two months of his second term, President Donald Trump has exhibited a flagrant disregard for the Constitution. His attempts to roll back birthright citizenship, freeze federal spending, and shut down the US Agency for International Development are blatant violations of the nation’s foundational document.

Constitutional Violations by Trump Administration

The Constitution explicitly states that individuals born in the United States are citizens, with limited exceptions that do not apply to Trump’s proposed rollback. Additionally, Congress, not the President, holds the authority to allocate federal funds. Trump’s actions in these instances are clear breaches of these constitutional provisions.

Judicial Response

The courts have not been lenient in their treatment of Trump’s unconstitutional actions. Thus far, the administration has complied with court orders blocking its unlawful measures. However, Vice President JD Vance has suggested that Trump disregard these orders and operate without legal constraints.

Potential Escalation into a Constitutional Crisis

A full-blown constitutional crisis could emerge in two ways. First, if Trump openly defies a court order, the only lawful recourse would be impeachment. Given the Senate’s failure to convict him in 2021 despite inciting an attack on the US Capitol, a successful impeachment seems improbable.

The second possibility is more dire: the complicity of the courts, particularly the Supreme Court, in Trump’s assault on the Constitution. With a 6-3 Republican majority, it is conceivable that the justices might align themselves with the Republican President.

Supreme Court’s Role

Last July, the Republican justices ruled that Trump is immune from prosecution for almost all offenses committed in his official capacity as President. This decision suggests a willingness to grant the President a degree of immunity that could facilitate future constitutional violations.

If the justices uphold Trump’s unconstitutional actions, such as his attack on birthright citizenship or his impoundment of federal funds, they would legitimize these breaches. This would embolden Trump and his allies in Congress to continue supporting his actions.

Uncertain Future

It remains unclear whether Trump or his Supreme Court allies will precipitate a constitutional crisis. The possibility of open defiance of court orders or judicial complicity in unconstitutional actions looms over the nation. The future of American democracy rests on the outcome of this uncertain struggle between constitutional adherence and potential tyranny.
