U.S. Government Releases Redacted Documents in Prince Harry Visa Case

The U.S. government on Tuesday released documents pertaining to Prince Harry’s 2020 visa application, but large portions of the documents were redacted. The redactions were put in place to protect the Duke of Sussex’s privacy and to avoid any perceived special treatment, according to government officials.

The release comes as a result of a Freedom of Information Act (FOIA) request filed by The Heritage Foundation, a conservative think tank. The foundation sought access to the documents to determine whether Prince Harry disclosed his prior drug use, as detailed in his memoir "Spare," on his visa application.

The released documents, consisting of more than 80 pages of court filings and transcripts, contained significant redactions, with large sections blacked out. Representatives for both Prince Harry and The Heritage Foundation have not yet issued statements regarding the release.

Government officials stated that The Heritage Foundation had not demonstrated that the public interest in disclosing the information outweighed Prince Harry’s right to privacy. They argued that the foundation’s speculation that the Duke may have received preferential treatment was not supported by any evidence of government misconduct.

"Plaintiffs allege that the records should be disclosed as public confidence in the government would suffer or to establish whether the Duke was granted preferential treatment," wrote Jarrod Panter, an official in the U.S. Citizenship and Immigration Services, which is part of the Department of Homeland Security. "This speculation by plaintiffs does not point to any evidence of government misconduct."

The case stems from Prince Harry’s public admission in his 2023 memoir "Spare" that he had used cocaine and marijuana. These revelations raised questions about whether he disclosed this drug use on his U.S. visa application. Under U.S. immigration law, admitting to drug use can potentially disqualify an individual from obtaining a visa.

Prince Harry and his wife, Duchess Meghan, stepped down from their royal duties in Britain and relocated to the United States in 2020. Their move to the U.S. has been a subject of considerable public interest and scrutiny.

The Heritage Foundation, known for its conservative stance, is also the publisher and leader of Project 2025, a conservative federal policy guide that aligns with many of former President Donald Trump’s policies. The group advocates for policies such as mass deportation of undocumented immigrants.

The foundation has previously alleged that Prince Harry may have concealed his past drug use on his visa application, which could have made him ineligible for a U.S. visa. These allegations were reported by British media outlets such as The Times and Sky News.

The government’s decision to release redacted documents suggests a balance between transparency and the protection of personal privacy. The case highlights the complexities of applying immigration laws to high-profile individuals and the public’s interest in ensuring that these laws are applied fairly and consistently.

The redactions in the released documents will likely fuel further debate about the level of transparency that is appropriate in such cases. The Heritage Foundation may continue to pursue legal avenues to gain access to the unredacted documents, arguing that the public interest outweighs Prince Harry’s right to privacy.
