Pacers Fans File Lawsuit Against Bucks and Patrick Beverley for Playoff Incident
Indianapolis, Indiana – Two Indiana Pacers fans have filed a lawsuit against the Milwaukee Bucks and former Bucks guard Patrick Beverley following an incident during an NBA playoff game in Indianapolis last year.
The lawsuit, filed in Marion County (Ind.) Superior Court, alleges that the fans experienced mental anguish and humiliation after Beverley twice threw a basketball towards fans seated behind the team bench in the waning moments of the Bucks’ 120-98 playoff loss to the Pacers on May 2, 2022.
The plaintiffs, identified as Rachel Noonan and Carrie Kaufman, claim that despite Beverley’s actions, they were ultimately escorted from the game. The lawsuit names Beverley, the Bucks organization, and former assistant coach Josh Oppenheimer as defendants, seeking compensation for lost wages and medical expenses.
Allegations of Misconduct and Negligence
"We believe that the Milwaukee Bucks fostered a culture of misconduct by their players without any repercussions," said John Kautzman, the attorney representing the plaintiffs, according to the Indiana Lawyer. The lawsuit alleges that the Bucks failed to properly supervise Beverley and prevent him from engaging in unsportsmanlike conduct.
The plaintiffs also claim that the Bucks’ actions, including Oppenheimer’s alleged involvement in directing security to remove the fans, were negligent and caused them distress.
Beverley’s Actions and NBA Suspension
Patrick Beverley, now with the Los Angeles Lakers, was known for his aggressive and emotional style of play during his time with the Bucks. The incident in Indianapolis led to a four-game suspension from the NBA for unsportsmanlike conduct. However, he has not yet served the suspension due to his move to Europe.
Lack of Comment from Bucks Organization
Bucks officials have declined to comment on the lawsuit, while Beverley could not be immediately reached for a response. The incident has raised questions about player conduct and the responsibilities of teams to maintain a safe and positive environment for fans.
Legal Precedent and Potential Outcomes
Similar cases involving fan-player confrontations have been brought before courts in the past. In 2019, a fan who was hit by a basketball thrown by Toronto Raptors point guard Kyle Lowry during a game won $250,000 in a settlement.
The outcome of the lawsuit filed by the Pacers fans will depend on a variety of factors, including the evidence presented by both sides, the interpretation of relevant laws, and the jury’s assessment of the facts. If successful, the plaintiffs could be awarded monetary damages for their alleged injuries and lost wages.
The lawsuit serves as a reminder of the need for professionalism and restraint in sports and highlights the importance of creating a respectful and inclusive environment for both players and fans.
