Title IX Probe Launched Against Maine DOE and School for Ignoring Trump’s Transgender Athletes Order

The Battle for Title IX: Maine and Other States Under Investigation for Alleged Transgender Athlete Violations

The United States Department of Education (USDOE) has embarked on a series of Title IX investigations into state education departments and school districts for allegedly ignoring President Donald Trump’s executive order on transgender athletes in girls’ and women’s sports. Maine joins California and Minnesota as the latest states to face scrutiny for reportedly allowing biological males to compete against biological females.

Maine Department of Education Investigation

The USDOE’s Office for Civil Rights (OCR) has initiated a directed investigation of the Maine Department of Education (MDOE) amid allegations that it has violated federal antidiscrimination law. The OCR claims that MDOE has allowed male athletes to compete in girls’ interscholastic athletics and denied female athletes female-only intimate facilities.

MSAD #51 Investigation

OCR is also investigating Maine School Administrative District #51 (MSAD #51) after receiving reports that Greely High School, a school under its jurisdiction, is permitting a male student to participate in girls’ sports categories.

Trump vs. Mills Clash

The investigation comes amidst a heated clash between President Trump and Maine Governor Janet Mills over the issue of transgender women in sports. Trump demanded that Maine comply with his executive order, threatening to cut off federal funding. Governor Mills vowed to resist, stating that she would "see [Trump] in court."

Title IX and Federal Funding

The USDOE has emphasized that states receiving federal education funding must adhere to Title IX, which prohibits discrimination based on sex. Acting Assistant Secretary for Civil Rights Craig Trainor stated that Maine has the choice to either comply with Title IX or forfeit federal funding.

Other Investigations

The USDOE is also investigating San Jose State University, the University of Pennsylvania, and a Massachusetts high school for alleged violations related to transgender athletes. Notably, Blaire Fleming and Lia Thomas, transgender athletes, competed for San Jose State and the University of Pennsylvania, respectively, with Thomas winning an NCAA Division I title in 2022.

Trump’s Executive Order

President Trump signed the "Keeping Men Out of Women’s Sports" executive order on February 5, 2021. The order directed federal agencies to enforce Title IX and establish policies prohibiting biological males from competing in girls’ and women’s sports.
