NYC TdA Gang Members Released on Reduced Charges After Guns and Drugs Raid

Tren de Aragua Gang Suspects Freed on Lesser Charges in NYC Gun and Drug Raid

Background:

The Tren de Aragua (TdA) is a notorious criminal organization from Venezuela known for its violent activities, including drug trafficking, extortion, and human smuggling. In recent months, concerns have grown over the gang’s expanding presence in the United States, particularly in major cities such as New York City.

Arrests and Charges:

On February 5th, 2023, law enforcement conducted a raid on V&R Auto and Collision in Woodside, Queens, leading to the arrest of three individuals: Jose Tamaronis-Caldera, 27, Richard Garcia, 33, and Rafael Nieves, 54. Police discovered a Glock handgun, two imitation pistols, and a significant quantity of drugs at the auto repair shop.

Initially, all three suspects faced felony drug and gun charges. However, subsequent court proceedings resulted in a reduction of charges for Tamaronis-Caldera and Garcia. They are now each charged with two misdemeanors: possession of an air pistol or air rifle and possession of an imitation firearm.

ACD and Dismissal:

As part of an adjournment in contemplation of compliance (ACD), Tamaronis-Caldera and Garcia are scheduled to have their charges dismissed on August 5th, 2023, provided they commit no further crimes. This means they were released without bail.

Nieves, who faced more serious charges, also had his charges reduced. He is now charged with criminal possession of a firearm and imitation handgun, as well as criminal possession of a controlled substance in the seventh degree. The Queens District Attorney’s office explained that these charges are not eligible for bail because the gun was unloaded and no ammunition was found nearby.

Migrant Shelter Connections:

According to police, Tamaronis-Caldera and Nieves reside at the Crowne Plaza JFK Airport hotel, which has been converted into a migrant shelter. Garcia’s address was given as the Roosevelt Hotel in Manhattan, another migrant shelter. Both Tamaronis-Caldera and Garcia reportedly crossed the U.S. border illegally in 2023 and were subsequently released.

Concerns and Criticism:

The reduction of charges against Tamaronis-Caldera and Garcia has raised concerns among law enforcement officials. They believe that the suspects are members of a known criminal organization and should face more serious consequences.

"These are not misguided individuals," a law enforcement official stated. "They’re documented members of a known violent criminal enterprise… the best we can do is let them out?"

Spiking Migrant-Related Crime:

Law enforcement data has shown a notable rise in migrant-related crime under the Biden administration, coinciding with the unprecedented number of border-crossers entering the country. In response, the Department of Homeland Security has enhanced efforts to identify and apprehend dangerous individuals, including members of organized crime groups like the Tren de Aragua.
